For a fourth violation—. For a fifth violation—. For any subsequent violation—. The Director of the Office of Personnel Management shall by rule establish procedures providing for an appeal from any adverse action taken under section by not later than 30 days after the date of the action.

An adverse action taken under section including a determination in an appeal from such an action under subsection a of this section shall not be subject to—.

Nothing in this chapter may be construed to—. Not later than 1 year after the date of enactment of this Act, the Director of the Office of Personnel Management shall issue such regulations as are necessary to carry out chapter 92 of title 5, United States Code as added by this Act.

Section of title 5, United States Code as added by this Act , shall take effect on the date that is 2 years after the date of enactment of this Act. The table of chapters for part III of title 5, United States Code, is amended by inserting after the item relating to chapter 91 the following:. The Congressional Accountability Act of 2 U. Section of title 5, United States Code. In this section, the terms agency , criminal history record information , and suspension have the meanings given the terms in section of title 5, United States Code, except as otherwise modified by this section.

Except as provided in subparagraph B , an employee of an employing office may not request that an applicant for employment as a covered employee disclose criminal history record information if the request would be prohibited under section of title 5, United States Code, if made by an employee of an agency. For purposes of applying that section under subparagraph A , a reference in that section to a conditional offer shall be considered to be an offer of employment as a covered employee that is conditioned upon the results of a criminal history inquiry.

The provisions of section of title 5, United States Code, shall apply to employing offices, consistent with regulations issued under subsection d. The remedy for a violation of subsection b 1 shall be such remedy as would be appropriate if awarded under section of title 5, United States Code, if the violation had been committed by an employee of an agency, consistent with regulations issued under subsection d , except that the reference in that section to a suspension shall be considered to be a suspension with the level of compensation provided for a covered employee who is taking unpaid leave under section An applicant for employment as a covered employee who alleges a violation of subsection b 1 may rely on the provisions of title IV other than section or , or a provision of this title that permits a person to obtain a civil action or judicial review , consistent with regulations issued under subsection d.

Not later than 18 months after the date of enactment of the Fair Chance to Compete for Jobs Act of , the Board shall, pursuant to section , issue regulations to implement this section.

The regulations issued under paragraph 1 shall be the same as substantive regulations issued by the Director of the Office of Personnel Management under section 2 b 1 of the Fair Chance to Compete for Jobs Act of to implement the statutory provisions referred to in subsections a through c except to the extent that the Board may determine, for good cause shown and stated together with the regulation, that a modification of such regulations would be more effective for the implementation of the rights and protections under this section.

Section a 12 and subsections a through c shall take effect on the date on which section of title 5, United States Code, applies with respect to agencies. Section 62 e 2 of the Internal Revenue Code of is amended by striking or and inserting , or Section of title 28, United States Code, is amended by adding at the end the following:. The Director may take such adverse action with respect to a covered employee who violates paragraph 2 as would be appropriate under section of title 5 if the violation had been committed by an employee of an agency.

The Director shall by rule establish procedures providing for an appeal from any adverse action taken under subparagraph A by not later than 30 days after the date of the action. Except as provided in subparagraph B , an adverse action taken under subparagraph A including a determination in an appeal from such an action under subparagraph B shall not be subject to appeal or judicial review.

Not later than 18 months after the date of enactment of the Fair Chance to Compete for Jobs Act of , the Director shall issue regulations to implement this subsection. The regulations issued under subparagraph A shall be the same as substantive regulations promulgated by the Director of the Office of Personnel Management under section 2 b 1 of the Fair Chance to Compete for Jobs Act of except to the extent that the Director of the Administrative Office of the United States Courts may determine, for good cause shown and stated together with the regulation, that a modification of such regulations would be more effective for the implementation of the rights and protections under this subsection.

Paragraphs 1 through 4 shall take effect on the date on which section of title 5 applies with respect to agencies. Prohibition on criminal history inquiries by contractors prior to conditional offer.

Chapter 47 of title 41, United States Code, is amended by adding at the end the following new section:. Except as provided in paragraphs 2 and 3 , an executive agency—. The prohibition under paragraph 1 does not apply with respect to a contract if consideration of criminal history record information prior to a conditional offer with respect to the position is otherwise required by law.

The prohibition under paragraph 1 does not apply with respect to—. Not later than 16 months after the date of enactment of the Fair Chance to Compete for Jobs Act of , the Administrator of General Services, in consultation with the Secretary of Defense, shall issue regulations identifying additional positions with respect to which the prohibition under paragraph 1 shall not apply, giving due consideration to positions that involve interaction with minors, access to sensitive information, or managing financial transactions.

The regulations issued under clause i shall—. The Administrator of General Services shall establish and publish procedures under which an applicant for a position with a Federal contractor may submit to the Administrator a complaint, or any other information, relating to compliance by the contractor with subsection a 1 B. If the head of an executive agency determines that a contractor has violated subsection a 1 B , such head shall—.

The term conditional offer means an offer of employment for a position related to work under a contract that is conditioned upon the results of a criminal history inquiry. The term criminal history record information has the meaning given that term in section of title 5.

The table of sections for chapter 47 of title 41, United States Code, is amended by adding at the end the following new item:. Section of title 41, United States Code, as added by paragraph 1 , shall apply with respect to contracts awarded pursuant to solicitations issued after the effective date described in section 2 b 2 of this Act. Chapter of title 10, United States Code, is amended by inserting after section the following new section:.

Except as provided in paragraphs 2 and 3 , the head of an agency—. Not later than 16 months after the date of enactment of the Fair Chance to Compete for Jobs Act of , the Secretary of Defense, in consultation with the Administrator of General Services, shall issue regulations identifying additional positions with respect to which the prohibition under paragraph 1 shall not apply, giving due consideration to positions that involve interaction with minors, access to sensitive information, or managing financial transactions.

The Secretary of Defense shall establish and publish procedures under which an applicant for a position with a Department of Defense contractor may submit a complaint, or any other information, relating to compliance by the contractor with subsection a 1 B.

If the Secretary of Defense determines that a contractor has violated subsection a 1 B , the Secretary shall—. Section a of title 10, United States Code, as added by paragraph 1 , shall apply with respect to contracts awarded pursuant to solicitations issued after the effective date described in section 2 b 2 of this Act.

The table of sections for chapter of title 10, United States Code, is amended by inserting after the item relating to section the following new item:. Not later than 18 months after the date of enactment of this Act, the Federal Acquisition Regulatory Council shall revise the Federal Acquisition Regulation to implement section of title 41, United States Code, and section of title 10, United States Code, as added by this section.

The Federal Acquisition Regulatory Council shall revise the Federal Acquisition Regulation under paragraph 1 to be consistent with the regulations issued by the Director of the Office of Personnel Management under section 2 b 1 to the maximum extent practicable. The Council shall include together with such revision an explanation of any substantive modification of the Office of Personnel Management regulations, including an explanation of how such modification will more effectively implement the rights and protections under this section.

To improve hiring and human resources flexibilities for Federal agencies in geographic areas affected by unique situations or circumstances, including remoteness, that cause recruitment and retention challenges, and to provide agencies bovernment such challenges with a toolkit of resources to overcome those challenges. It is the sense of Congress that—. Federal agencies should take aggressive action to respond to hiring govtrcak retention challenges in geographic areas affected by a unique situation or circumstance, including when such challenges develop from a need to government agencies not on usajobs govtrack – government agencies not on usajobs govtrack positions or retain employees due to the remoteness of the agebcies area in question.

Section nkt title 5, United States Code, is amended—. Recruitment and retention difficulties in geographic areas affected by unique situations or circumstances. In this subsection, the term geographic area affected by a unique situation or circumstance means an area within the continental United States in which the recruitment and retention of Federal employees govtracj become a severe challenge for an agency as the direct result of a dramatic economic development, hardship, or other relevant situation, including remoteness, that has a substantial impact on the area.

An agency may demonstrate that a geographic area is affected by a unique situation or circumstance that has directly and significantly affected recruitment and retention of employees in the area by—.

If an agency uses the direct hiring authority under subsection a 3 B iiithe agency shall work to prioritize the hiring of veterans by following the principles contained in part of title 5, Code of Federal Regulations, or any usa flag gifts regulation, regarding the appointment of qualified veterans to the competitive service.

Section b 4 of title 5, United States Code, is amended by striking any other circumstances which and inserting any other circumstances, including the location of a position in a geographic area affected by a unique situation or circumstance that has directly and significantly affected recruitment and retention of employees in the area as described in section a 3 B iiithat.

Section b 1 of title 5, United States Code, is amended by striking bonus and inserting the following: bonus, including a position government agencies not on usajobs govtrack – government agencies not on usajobs govtrack a geographic area affected by a unique situation or circumstance that has directly and significantly affected recruitment and retention of employees govtraxk the area as described in section a 3 B iii.

Section b agencjes of title 5, United States Code, is amended—. Commuting factors. For purposes of paragraph 1the Director of the Office of Personnel Management shall prescribe by regulation a mileage fovernment rate that is equivalent, to the maximum extent gofernment, to the mileage reimbursement rate for privately owned automobiles prescribed by the Administrator of General Government agencies not on usajobs govtrack – government agencies not on usajobs govtrack under section b 2.

Notwithstanding section of this title, an employee of an Executive department or an independent establishment who is assigned to duty, except temporary duty, at a site so remote from the nearest local infrastructure as to require an appreciable degree of expense, hardship, and inconvenience, beyond that normally encountered in metropolitan life, on the part of the employee, is entitled, in addition to pay otherwise due the employee, to an allowance in an amount not to exceed the necessary amount per day, as determined by the agency that employs the employee in accordance with paragraph 2 of this subsection.

In determining the necessary amount of an allowance under paragraph 1an agency govyrack consider the factors considered by the Director of the Office of Personnel Management under subpart B of part of title 5, Code of Federal Regulations. An agency may not pay an allowance under paragraph 1 unless the Director of the Office of Personnel Usauobs approves the amount of the allowance.

For purposes of this subsection, the term local infrastructure means—. Office of Personnel Management mandates. In this chapter—. The Director shall establish a permanent hiring working group referred to in this section as npt working group in the Office to help agencies prepare and deal with geographic areas that are affected by a unique usajogs or circumstance, including remoteness, that directly and significantly affects gaencies ability of the agencies to recruit and retain employees.

The working group shall continuously examine—. In carrying out its duties under this section, the working group shall consult with outsider stakeholder and Federal employee groups, as necessary. If the Director determines that an agency is eligible to exercise geographically related hiring and human resources flexibilities, the Director shall—. Not later than days after the date on which the Director establishes the working group, the working group shall submit to the Director a strategy that contains recommendations on how to improve the application process for agency use of hiring and human resources flexibilities, including—.

In preparing the strategy under paragraph 1the working group shall examine how to improve the ability of agencies to access the flexibilities described in that paragraph in a timely fashion to meet critical human resource challenges, including when a geographic area is affected by a situation uasjobs circumstance that directly and significantly affects the ability of an agency to recruit and retain employees.

The working group may, as needed, develop recommendations for Congress regarding appropriate legislative changes, including changes to existing hiring and human resources flexibilities including geographically related hiring and human resources flexibilitiesneeded to improve the ability of agencies to meet their hiring and retention needs.

The working group shall update the strategy required under paragraph 1 and develop new recommendations if the Director determines that the strategy needs to be updated. In determining whether the strategy required under paragraph 1 needs to be updated, the Director may consult with the heads of other agencies. The Director shall improve education regarding hiring and human resources flexibilities including geographically related hiring and human resources flexibilities for all agencies by—.

The Director shall evaluate, on an annual basis, agencoes extent to which training conducted directly by the Office and by agencies has improved the hiring and retention ability of agencies that face unique situations or circumstances that impact hiring and retention.

The evaluation conducted under paragraph government jobs the usa shall include—. If a geographic area is affected by a unique situation or circumstance that directly affects the ability of an agency to recruit and retain employees, including situations or circumstances where the remote location of a position significantly impacts the ability of an agency to recruit or retain employees, the agency shall—.

An agency shall usajobss annual training sessions for employees of the agency on hiring and human resources flexibilities including geographically related hiring and human resources flexibilitiesof which the Chief Human Capital Officer of gogernment agency or a designee shall conduct not less than 2 training sessions for each employee of the agency serving in agency headquarters or field offices involved in the recruitment, hiring, assessment, or selection of candidates.
